These Terms and Conditions govern your use of the services provided by World Medical Concierge Ltd (referred to herein as “WMC”, “we”, “us” or “our”), a company registered in England and Wales with its principal offices at Harley Street, London W1G. By engaging our services or using our website at www.worldmedicalconcierge.com, you agree to be bound by these terms.

Please read these terms carefully before using our services. If you do not agree with any part of these terms, you should not use our services or website.

1. Definitions and Interpretation

In these Terms and Conditions, the following definitions apply:

“Client” or “Patient” means any individual, their authorised representative or organisation engaging our services.

“Services” means the medical concierge, coordination, advisory and facilitation services provided by WMC, including but not limited to specialist referrals, appointment scheduling, second medical opinions, treatment planning, travel and accommodation coordination and VIP medical coordination.

“Partner Providers” means the hospitals, clinics, specialists, consultants, diagnostic facilities and other healthcare professionals within our network.

“Website” means www.worldmedicalconcierge.com and any associated subdomains.

2. Nature of Our Services

WMC acts as a medical concierge and coordination service. We facilitate access to healthcare services provided by independent third-party medical professionals and institutions. It is important to understand the following:

WMC does not itself provide medical treatment, diagnosis or clinical care. All clinical services are delivered by independent Partner Providers who are responsible for their own clinical decisions, treatment protocols and regulatory compliance.

Our role is to coordinate, advise on options and facilitate access to appropriate medical professionals based on the information provided to us. We exercise reasonable care and professional judgement in our recommendations, drawing on over 35 years of experience in healthcare coordination.

Any information provided by WMC, whether on our website, via correspondence or through our consultation services, does not constitute medical advice and should not be treated as a substitute for professional medical consultation with a qualified healthcare provider.

3. Use of Our Services

By engaging our services, you agree to:

(a) Provide accurate, complete and truthful information regarding your medical history, current health status and any other details reasonably required for us to perform our services effectively.

(b) Inform us promptly of any changes to your medical condition, contact details or circumstances that may affect the services we are providing.

(c) Attend scheduled appointments or provide reasonable notice of cancellation in accordance with the cancellation policies of the relevant Partner Provider. WMC shall not be liable for fees incurred due to missed or late-cancelled appointments.

(d) Comply with all applicable laws and regulations, including immigration and visa requirements where international travel for medical treatment is involved.

(e) Not use our services for any unlawful purpose or in any manner that could damage, disable or impair our operations or website.

4. Fees, Payment and Cancellation

WMC concierge coordination fees and any applicable charges will be communicated to you in advance of service engagement. Fees for medical consultations, diagnostic procedures, treatments and other clinical services are set by the relevant Partner Providers and are payable directly to them unless otherwise agreed in writing.

All fees quoted are exclusive of VAT unless expressly stated otherwise. Payment terms will be specified in the engagement confirmation provided to you.

Cancellation of WMC coordination services must be communicated in writing. Where cancellation occurs after arrangements have been made with Partner Providers, you may be liable for any non-recoverable costs incurred on your behalf, including but not limited to appointment fees, deposit charges, accommodation bookings and travel arrangements.

WMC reserves the right to amend its fees at any time. Any changes will not affect services already confirmed and in progress.

5. Patient Confidentiality

WMC treats all patient information with the highest level of confidentiality. We are committed to maintaining strict privacy protocols that meet and exceed the requirements of the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and all applicable healthcare confidentiality regulations.

Your personal and medical information will only be shared with Partner Providers and third parties to the extent necessary for the delivery of the services you have requested or as required by law. We will always seek your explicit consent before sharing sensitive medical information unless disclosure is legally mandated.

6. Limitation of Liability

To the fullest extent permitted by law, WMC’s liability in connection with the services provided shall be limited as follows:

Clinical outcomes. WMC does not accept liability for the clinical outcomes of any treatment, procedure, consultation or medical advice provided by Partner Providers. Each Partner Provider operates independently and is solely responsible for the standard of care they deliver.

Third-party services. WMC shall not be liable for the acts, omissions, negligence or defaults of any third party, including Partner Providers, accommodation providers, transport operators or any other service providers engaged in connection with your care.

Indirect losses. WMC shall not be liable for any indirect, consequential or incidental loss or damage, including but not limited to loss of income, loss of business opportunity or emotional distress, howsoever arising.

Maximum liability. In any event, WMC’s total aggregate liability to you in respect of any claim or series of connected claims shall not exceed the total fees paid by you to WMC for the specific engagement giving rise to the claim.

Nothing in these terms shall exclude or limit WMC’s liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or any other liability that cannot lawfully be excluded or limited.

7. Intellectual Property

All content on the WMC website, including but not limited to text, graphics, logos, brand identifiers, images, audio, video, software and the design, selection and arrangement thereof, is the property of World Medical Concierge Ltd or its licensors and is protected by United Kingdom and international copyright, trademark and other intellectual property laws.

The World Medical Concierge name, logo and all related names, logos, product and service names, designs and slogans are trademarks of World Medical Concierge Ltd. You must not use such marks without our prior written permission.

You may not reproduce, distribute, modify, create derivative works of, publicly display or in any way exploit any of the content on our website without our express written consent, except for personal, non-commercial use in connection with your engagement of our services.

8. Website Use and Disclaimers

The information provided on our website is for general informational purposes only. While we endeavour to keep the content accurate and up to date, WMC makes no representations or warranties, express or implied, regarding the completeness, accuracy, reliability or availability of the website or any information, products, services or related materials contained therein.

Our website may contain links to third-party websites. These links are provided for convenience only and do not signify our endorsement of such websites. WMC has no control over the content of linked sites and accepts no responsibility for them.

We reserve the right to modify, suspend or discontinue any aspect of our website at any time without prior notice.

9. Data Protection and GDPR Compliance

WMC is committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. We process personal data, including special category health data, on lawful bases including your explicit consent, the performance of our contract with you and our legitimate interests in providing medical concierge services.

Where we transfer personal data internationally in connection with the coordination of overseas medical treatment, we ensure appropriate safeguards are in place in compliance with UK data protection legislation.

10. Force Majeure

WMC shall not be held liable for any failure or delay in the performance of our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, epidemics, acts of government, war, terrorism, civil unrest, strikes, transport disruptions, communication failures or the inability of Partner Providers to deliver services.

11. Complaints and Dispute Resolution

WMC is committed to delivering the highest standard of service. Should you have any concerns or complaints regarding our services, please reach the concierge team in writing at the Harley Street offices or via email. WMC will acknowledge your complaint within five working days and aim to provide a full response within 20 working days.

Complaints relating to clinical care provided by Partner Providers should be directed to the relevant provider in the first instance, as they are independently responsible for their clinical services. WMC will, however, assist in facilitating communication where appropriate.

12. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

13. Changes to These Terms

WMC reserves the right to update or amend these Terms and Conditions at any time. Any changes will be posted on this page with an updated revision date. Continued use of our services or website following the posting of changes constitutes your acceptance of such changes. WMC recommends reviewing these terms periodically.
